        AACo (Australian Agricultural Company) places a primary value on protecting your privacy.         Items of personal information to be collected and methods of collection

        The Company collects personal information entered and provided by the information subject directly at the time of membership registration or events, for member management, information provision, marketing utilization, etc.

        Items of information to be processed: name, contact information, e-mail address

        The Company does not collect information from children under the age of 19 and may take steps to verify that the person is not under the age of 19 when signing up for membership.

        Purpose of collection and use of personal information

        The Company uses the collected personal information for the following purposes.

        - Provide event information

        - Use for marketing and advertising (guidance through SNS, e-mail, etc., delivery of advertising information)

        Period of retention and use of personal information

        In principle, the Company destroys the information without delay when the purpose of collecting and using personal information is achieved or when the member withdraws. However, if it is necessary to keep it for reasons according to company policy or reasons prescribed by laws and regulations as follows, the information will be retained. Such information will be destroyed immediately after storage for the period stipulated by the following and related laws and regulations, and will not be used for reasons other than the purpose specified below or laws and regulations even during the storage period.

        Procedure and method of destruction of personal information

        In principle, the Company destroys the information without delay after achieving the purpose of collecting and using personal information or after the retention period has elapsed. The destruction procedure and method are as follows.

        Destruction Procedure

        Regarding the collected personal information, after the purpose of collecting and using personal information is achieved or the retention period has elapsed, the information will be destroyed without delay. However, information that must be kept in accordance with this personal information processing and related laws and regulations will be stored for the period prescribed by laws and regulations and then destroyed. In this case, the personal data will be kept separately from other personal data being processed.

        Destruction method

        Personal information printed on paper is destroyed by shredding or incineration, and personal information stored in the form of electronic files is deleted using a technical method that cannot reproduce the record.

        Consignment of personal information processing

        The Company entrusts the processing of personal information to an external professional company as follows for the performance of the service. Consignment of personal information processing is made for each outsourcing company only if it is necessary for the performance of each individual service.

        When outsourcing the processing of personal information, in order to ensure the safety of personal information protection, we clearly stipulate the observance of instructions related to personal information protection, confidentiality of personal information, prohibition of provision to third parties and liability in case of accident, consignment period, return or destruction of personal information after the end of processing, etc., and supervise the outsourced company to safely process personal information.

        Provision of personal information to third parties

        The Company does not provide personal information to a third party unless the contents are notified and consent is obtained from the information subject. However, if it is necessary to submit or provide personal information in accordance with relevant laws and regulations, etc., it may be provided to a third party without the consent of the information subject.

        Overseas transfer of collected personal information

        Since the Company is headquartered in Australia, overseas transfer of personal information occurs when collecting personal information based on the use of this service. Matters related to overseas transfers are as follows.

        Rights of information subjects and how to exercise them

        The information subject and legal representative may view or correct the registered personal information of the information subject at any time. If you request to view, correct, or delete personal information, please contact the Privacy Officer by e-mail, and we will take action without delay after going through the identity verification process.

        If the information subject requests correction of errors in personal information, the personal information will not be used or provided until the correction is completed. In addition, if incorrect personal information has already been provided to a third party, we will notify the third party of the result of the correction without delay so that the correction can be made.

        Measures to ensure the safety of personal information

        The Company takes the following technical, administrative, and physical measures to ensure safety.

        Establishment and implementation of internal management plan

        • The Company establishes and implements an internal management plan for the safe processing of personal information.

        • The Company checks the implementation of personal information protection measures and the compliance of the person in charge through the in-house personal information protection organization, etc., and takes immediate corrective measures when a problem is found.

        Installation and operation of access control devices

        • The Company uses an intrusion prevention system to control unauthorized access from the outside, and strives to have all possible technical devices to ensure security in other systems.

        Measures to prevent falsification and alteration of access records

        • The Company keeps and manages records of access to the personal information processing system and uses security functions to prevent forgery or alteration of access records.

        Encryption of personal information

        • The personal information of the information subject is protected by a password, and the file and transmission data are encrypted, stored and managed, and important data is protected through a separate security function.

        Countermeasures against hacking

        • The Company uses vaccine programs to take measures to prevent damage caused by computer viruses. The vaccine program is updated periodically, and if a virus suddenly appears, the vaccine is provided as soon as it is released to prevent infringement of personal information.

        • The Company adopts a security device (SSL) that can safely transmit personal information on the network using an encryption algorithm.

        • In preparation for external intrusion such as hacking, each server uses an intrusion prevention system and a vulnerability analysis system to ensure security.

        • Personal information and general data are not stored in a mixed manner, but are stored separately through a separate server.

        Changes to the Privacy Policy

        If the Company changes this Privacy Policy, we will notify you so that you can check the contents. The information subject can check the changes to the Company's Privacy Policy.

        This Privacy Policy shall be effective as of 13 April 2023.

        Steal the Show Terms and Conditions
        Open only to South Korean residents (currently residing in South Korea) aged 20+. Must have a Facebook/Instagram account. Starts 12.01am 17/6/23 & ends 11.59pm 31/7/23 (Korean Standard Time). During competition period, sign up to Darling Downs website, follow @darlingdownswaguy and/or like @DarlingDownsWagyu Facebook page, purchase a Darling Downs cut & keep the receipt for proof of purchase. Then, create & take a photo of influencer’s recipe/dish and upload your photo to Instagram or Facebook tagging @darlingdownswagyu and using #stealtheshow #darlingdownswagyu. Privacy settings must be public. All entries will be judged. Winners will be sent the physical gift cards to the address of their choice. Winners told by direct messaging on Facebook or Instagram within 30 working days of winner determination date. The entries of all winners will be the Promoter’s property.         Event Terms and Conditions
        Promoter

        Competition Period
        • 12.01am on 017/06/2023 to 11.59pm on 31/07/2023.  All times are Korean Standard Time.

        Who can enter?
        • Only South Korean residents (currently residing in South Korea) who:

          • are aged 20 years or over; and

          • have a Facebook or Instagram account.

        Who can't enter
        • Directors, officers, management, and employees (and their immediate families) of:

          • the Promoter; and

          • the agencies, companies or participating premises associated with this competition.

        Entry instructions
        • To enter, you must, during the Competition Period:

        1. Access the Instagram or Facebook application on your smart phone or tablet and follow via Instagram @darlingdownswagyu and/or like the Darling Downs Wagyu official page on Facebook

        2. Join the Darling Downs Wagyu community and sign up on the website

        3. Purchase Darling Downs Wagyu, keep the receipt, and recreate influencers recipe.

        4. Take a photo of your created recipe (the photo must only feature and promote the Promoter's products); and

        5. upload the photo to either Instagram or Facebook or both and tag @darlingdownswagyu and use #stealtheshow #darlingdownswagyu. If entering via Instagram, your privacy settings must be set to public so the Promoter can access your entry.

        The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting an entry, including having the requisite photograph capability.

        How many winners will there be and how will they be chosen?
        • A judging panel appointed by the Promoter will review each valid entry. The winners will be selected at any time throughout the Competition Period based on the following criteria: creativity, overall appeal, and content which features the Darling Downs brand in the best way.

        • Chance plays no part in how the winners will be selected.

        • The 5 valid entries judged to be the best will each win a prize.

        • All judging decisions are as determined by the Promoter, in their absolute discretion.

        What can I win?
        • There are 5 prizes available.

        • Each prize is a ₩1,500,000 Shinsegae gift card (i.e., a year’s supply of Wagyu), to be used in any eMart store throughout South Korea.

        • Each winner will be contacted via direct messaging on Instagram or Facebook and asked for the address of their choice where they want the physical gift card to be delivered.

        • The gift card can be used at all Shinsegae affiliated brands.

        Total prize pool
        • The total prize pool is ₩7,500,000.

        How many times can I enter?
        • You can only enter one time.

        How and when will the winner/s be informed?
        • Winner/s will be notified via direct messaging on Instagram or Facebook within 30 working days of the winner determination date.

        • Winners' names (social media tag/handle) and associated social media image will also be published on the official Darling Downs Wagyu Facebook and Instagram pages.

        Unclaimed prize/s
        • If a prize has not been accepted or claimed within 30 working days of the winner determination date or if, after making all reasonable attempts, the Promoter can't contact a winner with the information provided by the entrant (or a winner does not contact the Promoter) within 30 working days of the winner determination date, the relevant entry/ies will be discarded, and the Promoter will re-award the relevant prize/s to the person who submitted the next best valid entry who has not already been awarded a prize.

        Collection and use of your personal information
        • If you are a winner, you must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You consent to the Promoter using your name and image on the official Darling Downs social media pages (Facebook and Instagram) and in any promotional or advertising activity.

        • The Promoter will collect your personal information (including your name, email address, and social media tag/handle and associated social media image) directly or through the Promoter's agents or contractors. The Promoter will use your personal information to conduct and manage the competition and your personal information will be transferred abroad.

        • The Promoter’s Privacy Policy (see: https://www.darlingdownswagyu.co.kr/en-kr-legal-1) includes information about:

          • how to seek access to the personal information the Promoter holds about you and seek correction of the information; and

          • how to complain about a privacy breach and how the Promoter will deal with such a complaint.

        • These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions.

        Entry
        • Your entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple aliases/social media accounts, you may be disqualified.

        • Every entry, including your photo/recipe/dish, must be your original work and not copied. All entries of all winners will be the Promoter's property.

        • The Promoter may copy and amend a winner's entry and may use (or allow others to use) a winner's entry and any rights in relation to the winner's entry, to publicise this competition or for any other purpose. These rights are perpetual, royalty free, world-wide, irrevocable, and transferable. For example, the Promoter may publish all or any part of a winner's entry or any amended version of it. The Promoter may also decide not to publish a winner's entry, to cease publication of a winner's entry, or to publish a winner's edited entry.

        • You warrant that your entry does not breach any third-party rights (for example, intellectual property rights) and its use by the Promoter or any other person will not breach such rights nor otherwise breach any law (for example, it is not defamatory, in contempt of court or in breach of any privacy law). Your entry must not be obscene, offensive, potentially insulting, scandalous, inflammatory, malicious, discriminatory, indecent or (in the Promoter's opinion) otherwise objectionable or inappropriate (for example it must not include nudity, defamatory images, or language the Promoter deems offensive).

        • You must not include any other person in your photograph unless they have consented to you submitting it in this competition. You must not include any person in your photograph who is under the age of 20 years.

        • You must ensure your entry does not contain any virus, malware or other malicious or inappropriate computer code or material.

        Prizes
        • Prize/s must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. Prize/s are subject to any additional terms and conditions imposed by the relevant supplier/issuer or the Promoter, including any validity period/s.

        • The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share the prize.

        General
        • Any failure by you to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s).

        • If you or your entry are deemed by the Promoter to breach these Terms and Conditions, your entry (or at the Promoter's discretion, all your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

        • The Promoter’s decision in connection with all aspects of this competition is final.

        • You must not:

          • tamper with the entry process;

          • engage in any conduct that may jeopardise the fair and proper conduct of the competition;

          • act in a disruptive, annoying, threatening, abusive or harassing manner;

          • do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;

          • breach any law; or

          • behave in a way that is otherwise inappropriate.

        • The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible, or incorrectly submitted including failure of any third parties to forward entry forms for inclusion in the draw, where relevant.

        • Prizes cannot be transferred or exchanged nor redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable taxes. The Promoter is not responsible for any change in prize value. You agree that if a prize is unavailable for any reason the Promoter may provide another item of equal or higher value.

        • If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, pandemic, public health orders and the like, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants.

        • The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice.

        Liability
        • Nothing in these Terms and Conditions restricts, excludes, or modifies any consumer rights under any statute.

        • Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).

        • Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prizes.

        • This competition is in no way sponsored, endorsed, or administered by, or associated with any social media platform, including Facebook, Instagram, and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
